So, let’s start first with some information about YouTube that may not be known to all.  At least, I keep having to hear people speak as if Google and YouTube are two different companies.  So here we go.

So, YouTube is an American subsidiary of Google.  Ok so, what about Google?

Google, Inc. was founded September 4, 1998; 20 years ago in Menlo Park, California.  Their headquarters are 1600 Amphitheatre Parkway, Mountain View, California, U.S. (https://en.wikipedia.org/wiki/Google)

Ok, so got that?  Goggle is a subsidiary of Alphabet Inc. and is also an American company.  Wait, What? Google isn’t the top level company? I thought Google was this huge company that ran other companies. Well, yes, it is.  However, it is also a subsidiary of Alphabet Inc. Ok so Alphabet Inc must not be an American company right? Well, let’s see…

It was created through a corporate restructuring of Google on October 2, 2015 and became the parent company of Google and several former Google subsidiaries. WAIT! Alphabet Inc. is American as well.  Well, yes and basically is adult Google and Google Junior is now Google.  Yeah, that’s right. So how are they able to ignore the First Amendment. Ok, let’s look at the First Amendment.

According to the Constitution of the United States the First Amendment ed by Congress September 25, 1789 and ratified by the States December 15, 1791 along with the First 10 Amendments known as the Bill of Rights.  The current form of the First Amendment states:

“Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.” (Rev. 1992)

This means: It is pretty plain in speech.  The First Amendment protects several basic freedoms in the United States including freedom of religion, freedom of speech, freedom of the press, the right to assemble, and the right to petition the government.

Ok so YouTube/Google/Alphabet are denying…. Stop right there.  It is a common misconception that the First Amendment prevents anyone, ie. Private/non-governing entities included, from encroaching on your freedoms guaranteed by the First Amendment.  It only covers governmental entities.

Great so YouTube/Google/Alphabet is going to do what they want to do unless someone huge sues them and cost them money.  We may as well give up now.

YouTube was given till August 23 2019 to respond. YouTube/Google/Alphabet waited till the last day before the countdown clock ran out, they received a formal written reply from Google .  So the clock is paused, but NOT stopped!

So with the threat of all the YouTubers being declared falsely self-employed, YouTube/Google is facing huge amount of fines.

Under the GDPR, the way they treat our videos going though all the bots and human censors is illegal. It could cost them 4% of the worldwide revenue of the previous year.  If they delay by trying not to pay, they can be hit with even more fines.

Will Google meet, but NOT negotiate?

Of course we had a ton of reporters covering the exciting news about the meeting. Some of them are saying that while they have agreed to meet, they won't negotiate about our demands.

Well, that is what the employer side always says before negotiations begin. Like, "we really think everything's just great and there is zero reasons for changes. But sure, if you insist we can always meet and chat about the weather or something".

They say they want to discuss "the future of work" with us. Of course that means the future of working for YouTube as a creator, what else. And we firmly believe that YouTube needs to be much more transparent, fair and humane in that regard. Our demands are designed to achieve that. So of course we will discuss our demands. Probably not much else BUT those.

The fact that Google relented and came back to us within the deadline speaks volumes. We really made an impact, else they would have ignored us. They are clearly afraid of the lawsuits, the fines and also the potential PR disaster.

We WILL change things. In fact we might already HAVE changed them. Just one day before our deadline would have ended, they published a video about "SNEAK PEEK: Talk to YT directly if you have been removed from YPP".

Just a coincidence? Mind you one of our demands is "We want to speak to a real human". Go figure.

I actually watched the video, they want you to basically send your video in so they can argue that your video is not violating the your video was suspended for.  This is a test program open to only those in the YouTube Partner Program.

WAIT! You suspended the video before you watched it and you can’t watch the video unless I send it to you?  WHAT? Something is messed up there.

My “final” thoughts: Do your research and decide what you want to do!  Speak up if you feel you need to or stand to the side and wait. (More things are coming you in other blogs.)

YouTube doesn't want any creators there. Their response was like a corporate entity saying an employee can settle their issues through HR after HR has failed to do anything to help the problems between the employees and the company.
